A 43-year-old Geraldton man who assaulted his mother on the day she died will be up for release today, taking into account time already spent in custody.

Damian Michael Reilly was today sentenced to 12 months jail, backdated to November 12 when he was taken into custody.

Reilly appeared before the District Court at Perth via videolink on the charge of endangering the life, health or safety of a person – downgraded from the original charge of assault occasioning death.

Judge Andrew Stavrianou said Reilly was aware of his mother’s frail condition, and described the violence as “alcohol fuelled”.

Reilly assaulted his mother, Gloria Anne Reilly, following a verbal argument between the two in their Beresford home at 7pm on November 13 last year.

The court heard that Reilly left the house after the incident and when he returned she was dead.
