Michael Franks Joseph Jocelyn: Man fined for vile threats against prison officers after breaching order

A prisoner who repeatedly threatened to stab and rape two female prison officers before covering himself in his own faeces was resentenced to a fine after breaching the order he was first placed on. Michael Franks Joseph Jocelyn was in the crisis care cell at Eastern Goldfields Regional Prison on June 13, 2022, when he became “enraged” that another person was getting their breakfast sooner than him and began hurling abuse and threats at the two female officers in his cell. Jocelyn told the women he knew what they looked like and he always carried a knife on him before threatening to stab them and attack them with a hammer if he saw them on the street. He also threatened to rape them before covering himself with his own faeces in his cell. The 46-year-old was resentenced for three counts of made a threat to unlawfully do an act when he appeared in Kalgoorlie Magistrates Court on Thursday after breaching the intensive supervision order he was sentenced to for the offending back in 2023. The court heard Jocelyn failed to report for supervision as directed by Adult Community Corrections and a few days later was taken into custody in Victoria. An ACC spokesperson said Jocelyn was arrested for allegedly kidnapping an underage girl he met on Snapchat. She also told the court Jocelyn had mostly complied with his order before then but noted he had been abusive to staff at points. Jocelyn represented himself in court on Thursday and tried to explain his reasoning behind the Victorian allegations but was stopped by magistrate Paul Lyons, who said he was dealing with only the resentencing matter. Jocelyn said that offending occurred in a “fit of rage” where he ran his mouth, but he did not mean what he was saying. “I am not a violent person, I just run my mouth,” he said. “It’s not healthy. It’s not good for me and it’s not good for people.” Mr Lyons said he had been left with “limited sentencing options” but Jocelyn’s behaviour was “appalling and deserves to be condemned”. He said his options were fines or imprisonment, and he did not believe Jocelyn deserved imprisonment due to his compliance for most of the order. “You say this was just you running your mouth, but obviously others don’t take it that way,” he said. “These are prison officers who are doing a difficult job and having to face convicted criminals . . . people who may very well carry out the threats they are making.” He fined Jocelyn $2500 for the resentence for the threats charges, and $450 for non-compliance on the order.
